Terms and Conditions
Last updated: October 20261. Scope, contracting parties
These Terms and Conditions govern all brokerage services provided by FALKNER Aviation Group, Till Zimpel, Karl-Schurtz-Straße 21, 70190 Stuttgart, Germany ("Falkner Aviation", "we") to customers ("customer", "you") in connection with the brokerage of full charter and empty-leg private jet flights.
Falkner Aviation acts exclusively as an intermediary between the customer and the AOC-licensed operator carrying out the flight ("operator"). The carriage contract for the actual flight is formed directly between the customer and the operator, not with Falkner Aviation.
Falkner Aviation does not operate its own aircraft, does not carry out flights, and is not an air carrier within the meaning of aviation regulations.
2. Description of services
At the customer's request, Falkner Aviation researches suitable charter or empty-leg offers from AOC-licensed operators and passes these offers on to the customer.
All prices and availability communicated via the website, email or WhatsApp are non-binding requests or indicative figures. A binding offer only arises once expressly confirmed by the respective operator.
Falkner Aviation offers only a single service (flight brokerage). No further travel services (e.g. hotel, rental car) are bundled. Falkner Aviation is therefore not a package travel organiser within the meaning of EU Directive 2015/2302 or the corresponding German provisions.
3. Formation of the brokerage contract
By submitting a request via the contact form, email or WhatsApp, the customer makes a non-binding offer to enter into a brokerage contract with Falkner Aviation.
The brokerage contract is formed once Falkner Aviation communicates a specific flight offer from the operator to the customer and the customer accepts that offer.
The actual carriage contract (charter or empty-leg contract) is formed separately and directly between the customer and the operator once the operator confirms the booking.
4. Prices, commission and payment
The total price communicated to the customer for the flight is payable to the operator carrying out the flight. Customer payments never pass through a Falkner Aviation account at any point.
Falkner Aviation receives a commission from the operator for the brokerage. This results in no additional cost to the customer.
Payment terms (due date, payment method) are determined by the respective operator.
5. Customer obligations
The customer is obliged to provide truthful and complete information when making a request (in particular route, date, number of passengers).
Travel documents, visa requirements and other entry regulations are the customer's responsibility.
6. Liability
Falkner Aviation is not liable for the proper performance of the flight itself; responsibility for this lies solely with the respective operator.
For damages arising from the brokerage activity, Falkner Aviation is liable only in cases of intent and gross negligence, for injury to life, body or health, and for breach of material contractual obligations; in the latter case liability is limited to foreseeable, typical damage.
Strict liability under the German Product Liability Act and other mandatory statutory liability provisions remain unaffected.
7. Right of withdrawal
Contracts for the carriage of passengers, including their brokerage, are excluded from the statutory right of withdrawal for distance contracts pursuant to Sec. 312g (2) BGB (German Civil Code). Accordingly, no right of withdrawal applies to Falkner Aviation's brokerage services.

9. Final provisions
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
